The Demise of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe felt a moment of respite on Monday, as the tension sparked by the presentation of a new 28-article proposal for resolving the conflict appeared – temporarily – to have been contained. A Washington representative spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its response: an extensive attack of rocket attacks on Kyiv.

The Pattern of Diplomacy and Destruction

The sequence of opposing developments captured the harsh reality of the current period. By day, negotiation efforts are fought: optimistic declarations are released from multiple capitals. Immense energy is expended on restraining specific proposals. By night, the Kremlin brutally reminds the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nighttime Reality

As Russia's attack developed into the early hours of Tuesday, the present situation of Ukraine's exposure was laid bare. Ukraine is equipped to monitor rocket firings from Russian territory, a ability enabled by timely intelligence. From observation points, Ukrainian air force fighter jets that had been dispatched to engage hostile aerial threats roared overhead – sophisticated military planes delivered to Ukraine by European allies.

Moments later, Kyiv's anti-aircraft weapons thundered: defensive missiles fired to intercept a hostile projectile. This was a sophisticated defense system at work, presumably provided by allied countries. Every firing jolts you unexpectedly, shaking the windows. The brief panic quickly transforms into grim resignation: possibly the approaching threat won't cause damage this time, preventing destruction from devastation and further power outages.

Persistent Threats

Soon after, a large-caliber weapon fired at a unmanned aircraft somewhere nearby, part of a defensive team – almost certainly allied-provided weaponry. Regrettably, the bullets missed the opposing UAV – it maintained course toward its destination.

Periodically, this carried on until dawn. Kyiv awoke to the early updates: several casualties, destruction and heating outages in numerous residences as a result of the nocturnal offensive. As typically, everyone still went about their day – enduring hostilities. But those entire period illustrated Ukraine's essential dependence on Western support – a dependence that European nations are clearly incapable to substitute in the short term.

Ineffective Peace Efforts

The detailed framework from US administration provoked deep reactions, debate and deep concern – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new initiative from Washington unfolds according to the same pattern: a political offensive against Ukraine, which Kyiv, with partner nations, manages to fend off. They manage the tension but never actually achieve victory. This cycle will, certainly, persist.

Political Considerations

It is tempting to accuse certain parties of persistently promoting Russian terms. But that does not seem to be the complete picture. Washington works based on a principle understood by experienced diplomats: you cannot win at the negotiating table what you have failed to defend militarily. The White House believes that it is unfeasible to compel Moscow to relinquish the territory that it presently holds in Ukraine's southern or eastern regions.

The issue is that while recognising this factual reality, American administration does little to prevent Kremlin actions, through words or deeds, from assuming that the situation will not evolve additionally in its favour in the near future.

Conflicting Perspectives

Therefore, Moscow is confident that the clock favors them – that Ukraine and its partners are approaching exhaustion. Their incentive to sign a deal that does not give them the maximum possible gain is close to zero. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains completely certain in the result.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding people and territory but avoiding a entire defensive failure until circumstances change in its favour.

Existing Situation

Realistically, there are no real preconditions for a truce. Now, subjective factors are becoming relevant: political desires to negotiate peace and achieve global acclaim, and Kyiv's dual difficulties – on one hand, not to distance important partners, and on the other, to rally Ukrainians around the country's interests against any proposal Kyiv finds unsuitable, so that their attention does not shift toward homefront challenges. And although their mission will now be considerably more difficult after latest incidents, it remains quite doubtful that this will modify their basic position.

These two forces are influencing discussions.

Assessment and Future

It took a mere seven days to terminate the 28 points of the current initiative. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the rest of Europe, along with pacifying measures of diplomats, and finally, current information leaks, all achieved their purpose.

While new plans based on established approaches are forthcoming, Kyiv, London and other European capitals should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and show certain reluctance to modify developments, if they remain united and improve their protective measures at a much faster pace. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the predictable period, mainly require ongoing international assistance.
